Terms and conditions of used equipment sales

Davies Implements – Used Machinery Terms and Warranty Statement

Part 1: Used machinery – terms of sale (for the website)

Our aim is never to mislead a customer when buying a used machine from us. Our main terms for the sale and delivery of used machinery are set out below.

  1. Prices and VAT. Prices shown for consumers include VAT. Prices marked “+VAT” are trade prices and are subject to VAT at the current rate. [Some machines may be sold under the VAT margin scheme, where VAT is not shown separately.]
  2. Delivery. Delivery is not included in the price unless stated, and will be quoted separately.
  3. Reserving a machine. We will reserve a used machine only when asked, on payment of a 10% deposit. We will hold the machine for 7 days unless our sales team agrees otherwise. A 10% deposit is also required when an order is placed and the machine is not delivered or collected straight away.
  4. Deposits.
    • Trade customers: deposits are non-refundable.
    • Consumers: if you change your mind, we may keep enough of the deposit to cover our reasonable costs and will refund the balance. This does not affect your right to cancel under point 10.
    • If we are unable to complete the sale, your deposit will be refunded in full.
  5. Payment. A machine will only be released for collection or delivery once payment has been received in full.
  6. Images and descriptions. Website images show the actual machine for sale unless stated otherwise. Descriptions, hours and service history are given in good faith from the information available to us.
  7. Condition. Used machines will show wear consistent with their age, hours and previous use. We will never knowingly offer a used machine with mechanical damage or performance issues without telling you. Any known faults will be described before sale and recorded on your invoice.
  8. Viewing. We recommend that you view the machine before buying.
  9. Sold as seen (trade only). Machines sold to trade customers as “sold as seen” are sold in their current condition with no warranty, as stated on the invoice.
  10. Buying online or by phone (consumers). If you are a consumer and buy without visiting our premises, you have the right to cancel within 14 days of receiving the machine. You will be responsible for the cost of returning it.
  11. Warranty. Any warranty on a used machine will be stated on the sales invoice and is subject to our terms set out below.
  12. Your rights. These terms do not affect your statutory rights as a consumer. Our full terms and conditions are available [here – insert link].

Part 2: Used machine warranty statement

Davies Implements Limited – Used Machine Warranty Statement, Version 2.0 ([date])

Any warranty offered on a used machine is subject to the following terms.

1. Warranty period

1.1 The warranty period varies by machine and, where a warranty is given, will be stated on the sales invoice.

1.2 The warranty begins on the date of delivery or collection.

2. Repairs under warranty

2.1 We will repair a fault covered by this warranty at our premises or at an approved repair centre chosen by us. Where it is reasonable, we may instead replace the faulty part.

2.2 Warranty work will be carried out during our normal opening hours.

2.3 This warranty does not cover components that have reached the end of their normal working life, or wear-and-tear items such as tines, blades, belts, chains, tyres and filters.

2.4 Business customers: our liability under this warranty is limited to repair or replacement as above. We accept no liability for indirect or consequential loss of any kind, including loss of profit, crops, production or downtime, or the cost of hiring replacement equipment.

2.5 Consumers: we are responsible for foreseeable loss caused by our breach of contract or negligence, but not for business losses.

3. Your responsibilities

3.1 You must operate the machine in accordance with the manufacturer’s instruction manual.

3.2 You must make the machine available for inspection by our technician, without it having been dismantled or worked on.

3.3 The warranty applies only to the person or business named on the sales invoice and cannot be transferred.

4. When the warranty may not apply

The warranty may not apply if:

  • the failed part or assembly has been tampered with or repaired by someone other than us without our agreement;
  • normal maintenance has not been carried out;
  • components have been incorrectly reassembled;
  • the machine has been modified without our written approval;
  • tractor-driven equipment has been used with a tractor that does not meet the manufacturer’s specification;
  • the machine has been used in abnormal conditions, overloaded or damaged by accident; or
  • the machine has been used for tasks contrary to the manufacturer’s instruction manual.

5. Your statutory rights

5.1 This warranty is in addition to your legal rights. If you are a consumer, nothing in this statement affects your rights under the Consumer Rights Act 2015, including your rights to a repair, replacement, price reduction or refund for goods that are not of satisfactory quality, taking into account the machine’s age, hours, price and description.

5.2 You are not entitled to claim for faults that we told you about before sale or that are recorded on your invoice.

6. Making a claim

6.1 Please contact us on 01267 237726 as soon as a fault appears, and stop using the machine if it is unsafe to continue. Please do not attempt a repair before speaking to us.
